1. Delivery / Activation

• Tender2U fees are count based on the Tender2U packages chosen.
• Tender2U subscription will be activated from the date of full payment acceptance.
  

2. Refund Policy

• Commerce Access Sdn Bhd do not refund account balances.
  
• Subscriber is aware that Commerce Access Sdn Bhd may prospectively change the specified rates and charges from time to time.

3. Cancellation / Termination / Suspension

• Account Cancellation: All account cancellation requests before the expiry date must be sent to tender2u@casb.com.my and include the following information:

• Company name
• MOf no / Company registration no
• reason for cancellation
• desire date of cancellation
• A cancellation confirmation e-mail will be sent to the primary e-mail address on the account.

• Subscriber’s account cancellation is not complete unless Subscriber receives a confirmation e-mail.
• Suspension of Service or Cancellation: Commerce Access Sdn Bhd reserves the right to suspend and cancel service at any time for any reason without credit or refund. Any violation of policies which results in extra costs will be billed to the Subscriber. (i.e. transfer, space etc.) Prior notification to the Subscriber is not assured. In extreme cases, law enforcement will be contacted regarding the activity.
• Termination : Tender2U will be terminated automatically without notice after the expiry date if there is no renewal payment made upon expiring.

4. Convert / Transfer / Upgrade

• Upgrading to higher Tender2U package or items is allowed at any time with written notice to Commerce Access Sdn Bhd. Payment shall be made within 7 days after the new package have been selected.

5. Account Expiry Notification

• Alert notification on the expiry date of the Tender2U will be sent via email to Subscriber 30 days before the Tender2U expires.

6. Indemnification

• Subscriber agrees that it shall defend, indemnify, save, and hold us harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against us, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Subscriber agrees to defend, indemnify, and hold us harmless against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with our servers; (2) any material supplied by Subscriber's infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customer from our servers.

7. Disclaimer

• We will not be responsible for any damages Subscriber business may suffer. We make no warranties of any kind, expressed or implied for services we provide. We disclaim any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by the hosting company and its employees. We reserve the right to revise our policies at any time. Subscriber further acknowledges that the Commerce Access Sdn Bhd's liability for its own negligence may not in any event exceed an amount equivalent to charges payable by subscriber for services during the period damages occurred. In no event shall the company be liable for any special or consequential damages, loss or injury.

8. Amendments

• Commerce Access Sdn Bhd reserves the right to revise its policies and service(s) at anytime. If Subscriber do not agree with any revision to the Agreement or change in service(s), Subscriber may terminate this Agreement at any time by terminating Subscriber account following the proper cancellation procedure as outlined in this TOS. Subscriber agrees that, by not terminating the account following any revision to this Agreement or change in service(s), Subscriber shall be bound by any such revisions and service changes.

• TENDER2U DEPENDS ON ITS SOURCES FOR THE ACCURACY AND RELIABILITY OF ITS INFORMATION. THEREFORE, NO RESPONSIBILITY IS ASSUMED BY TENDER2U OR ITS AGENTS FOR ERRORS OR OMISSIONS IN THIS TENDER NOTIFICATION. TENDER2U FURTHER EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. TENDER2U®
